1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Vestara", "we", "us", "our" — refers to Vestara, operating from Persiaran APEC 8, 63000 Cyberjaya, Selangor, Malaysia.
- "Services" — refers to the administrative and document organisation support arrangements described on this website, including the Open Ledger Consultation, Ledger-Managed Document Retrieval, and Full Estate Ledger Programme.
- "Client", "you", "your" — refers to the individual or family engaging Vestara for Services.
- "Ledger" — refers to the itemised written document prepared by Vestara setting out the scope, documents, offices, timings and charges relevant to a specific engagement.
- "Agreement" — refers to these Terms and Conditions together with the scope ledger agreed at the start of an engagement.
- "Website" — refers to the site at https://vestaras.blog
2. Acceptance of Terms
By using this website or engaging Vestara for Services, you confirm that you are at least 18 years of age, that you have the legal capacity to enter into a binding agreement, and that you accept these Terms and Conditions in full.
Where you are acting on behalf of a family or estate, you confirm that you have authority to engage Vestara and to provide the documents and information required for the Services.
3. Service Description
Vestara provides administrative and document organisation support for estate inventory and inheritance paperwork matters. Our Services are informational and organisational in nature. They include preparing itemised ledgers, drafting correspondence for client review and signature, tracking document requests with administrative bodies, coordinating translation and attestation where required, and maintaining indexed archives of documents received.
Our Services do not constitute and must not be construed as legal advice, financial advice, representation before any court or tribunal, or any other form of regulated professional service. Where a matter requires a qualified legal or financial practitioner, Vestara will mark that item clearly in the ledger and note the category of professional firm appropriate for that matter.
Services are available to clients in Malaysia. We do not operate outside Malaysia and do not undertake matters governed primarily by the laws of other jurisdictions.
4. Client Responsibilities
Clients are responsible for the following during the course of any engagement:
- Providing accurate and complete information at the time of enquiry and throughout the engagement
- Reviewing and signing correspondence prepared by Vestara before it is submitted to any office or institution
- Promptly notifying Vestara of any changes in circumstance that may affect the scope of the engagement
- Making payment of Vestara's service fees within the timeframe set out in the service agreement
- Paying office charges levied by government bodies and financial institutions directly, or reimbursing Vestara where those charges have been paid on the client's behalf
- Not using any document or correspondence prepared by Vestara for any purpose other than the stated administrative purpose
5. Payment Terms
Vestara's service fees are denominated in Malaysian Ringgit (RM). The applicable fee for each service arrangement is stated in the scope ledger provided prior to commencement of work. No work will begin until the scope ledger has been agreed and the arrangement fee has been received in full, unless otherwise stated in writing.
Office charges payable to government bodies and financial institutions are separate from Vestara's service fees. These charges will be listed as distinct rows in the scope ledger and are the responsibility of the client.
We do not offer refunds once work has commenced, except where Vestara is unable to deliver the agreed scope due to circumstances within our control. Requests for refund consideration before commencement should be submitted in writing to [email protected].
6. Scope and Changes
The scope of each engagement is defined by the written ledger agreed at the start. Where additional items or document requests fall outside the agreed scope, these will be documented as ledger amendments and may require additional fees, which will be stated in writing before any additional work proceeds.
Vestara does not undertake to complete any administrative process within a specified timeframe, as response windows are determined by the relevant offices and institutions, not by Vestara. Typical response windows are provided as estimates in the scope ledger.
7. Intellectual Property
All content on this website — including text, design, layout, and the ledger format — is the intellectual property of Vestara. You may not reproduce, distribute or use any part of this website or our service materials for commercial purposes without written permission.
Documents and correspondence prepared by Vestara on a client's behalf become part of that client's administrative record and may be used by the client for the stated administrative purpose.
8. Disclaimers
Vestara's Services are administrative in nature. We make no representation that any document request will be processed by the relevant body within any specific period, that any application will be approved, or that the outcome of any estate administration process will be as the client expects.
Nothing in our website content, in our scope ledgers, in our correspondence drafts, or in any communication from Vestara constitutes legal, financial or professional advice. We are not a law firm and are not regulated as a professional services provider in Malaysia.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Vestara's total liability to a client for any claim arising from an engagement shall not exceed the service fee paid by that client for the relevant engagement.
Vestara shall not be liable for any indirect, consequential, special or punitive damages, or for any loss of documents, data or information that are caused by circumstances outside Vestara's control, including delays or errors by third-party offices and institutions.
10. Confidentiality
Vestara will not disclose client information or estate documentation to any third party other than the administrative offices and institutions to which requests are being made, and only to the extent required for those requests. Personal data is handled as described in our Privacy Policy.
11. Termination
Either party may terminate a service engagement by giving written notice. Where a client terminates an engagement before completion, Vestara reserves the right to invoice for work completed to the date of termination at a pro-rated basis.
Upon termination, all client documents held by Vestara will be returned to the client within 14 working days. Digital copies held on Vestara's systems will be retained for 7 years and then deleted in accordance with our data retention policy.
12. Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. In the event of a dispute arising from an engagement, the parties agree to attempt to resolve the matter informally within 30 days of written notice of the dispute.
If informal resolution is not achieved, disputes shall be submitted to the courts of Malaysia, with jurisdiction in Selangor, unless both parties agree in writing to an alternative dispute resolution mechanism.
13. General Provisions
- Entire Agreement: These Terms and Conditions together with the relevant scope ledger constitute the entire agreement between the parties for the Services described.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
- Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
- Assignment: Vestara may assign its rights under these Terms to a successor organisation. Clients may not assign their rights without Vestara's written consent.
- Notices: Formal notices should be sent to [email protected] or by post to Vestara's registered address.
14. Changes to These Terms
We may update these Terms from time to time. The current version will always be available at this page with the effective date shown at the top. Continued use of this website or ongoing service engagement after an update constitutes acceptance of the revised Terms.
